DETAILS of the DISQUALIFICATION CASE filed against Mayor SERGIO G. AMORA, JR.

Highlights on the disqualification case filed against Mayor Sergio G. Amora, Jr., to wit:

• Sangguniang Bayan Member filed a case with the COMELEC on March 5, 2010; through his counsel Atty. George Erwin M. Garcia, seeking the disqualification of the Mayor Sergio G. Amora, Jr. in the May 10, 2010 National and Local Elections.
• The said case seeks to disqualify the candidacy of Mayor Amora for the mayoralty of Candijay, Bohol on the ground that Mayor Amora’s Certificate of Candidacy (COC) is allegedly null and void because the latter only presented his Community Tax Certificate rather than a competent evidence of identity to the Notary Public.



• On March 16, 2010 the 2nd Division of the COMELEC issued an Order signed by Commissioner Nicodemo T. Ferrer requiring Mayor Amora to file his answer and memorandum.
• March 29, 2010 – Mayor Amora filed his Answer cum Petition Paper.
• April 29, 2010 - the 2nd Division of the COMELEC issued a Resolution granting the petition for the Disqualification, signed by Commissioner Nicodemo T. Ferrer.
• April 30, 2010 – Mayor Amora through counsel filed for Motion for Reconsideration.
• May 6, 2010 – SB Member Olandria through counsel filed his Comment and Opposition.
• May 10, 2010, Mayor Amora garnered 58.94% of the total votes casts against erstwhile opponent Trygve Olaivar (41.06%).
• May 11, 2010 – Municipal Board of Canvassers of Candijay, Bohol proclaimed Mayor Amora as the winner for the position of Municipal Mayor.
• May 17, 2010, COMELEC through a divided vote of 4-3 issued a Resolution affirming the Resolution dated April 29, 2010 and disqualifying the candidacy of Mayor Amora, note that 3 of the COMELEC Commissioners namely: Comm. Gregorio Y. Larrazabal, Comm. Rene V. Sarmiento and Comm. Jose A.R. Melo filled their dissent and voted against the Resolution.
• May 21, 2010 SB Member Olandria through counsel filed a Most Urgent Motion to Annul Proclamation.
• May 28, 2010 Mayor Amora’s counsel Atty. Nicodemus A. Tago received a copy of the public respondent COMELEC’s Resolution dated May 17, 2010.
• June 01, 2010, counsels for Mayor Amora files a motion for a Restraining Order of the COMELEC Resolutions dated April 29 and May 17, 2010.
• TRO from Supreme Court was released on June 28, 2010. Copies were distributed.
